Instagram giveaway rules in 2026: run a fair comment giveaway

政策 2026年10月14日 阅读约 6 分钟

Instagram allows giveaways, as long as you follow its promotion rules and the law where your entrants live. In short: you are responsible for running it lawfully, you publish official rules, each entrant releases Instagram from responsibility, you say the giveaway isn't sponsored or run by Instagram, and you never ask people to tag content inaccurately. Sponsored giveaways also need a clear disclosure.

This guide covers each rule, the official rules to publish, how to keep entries fair, and how to pick and contact winners, including the DM limits that catch many hosts out. It isn't legal advice: for a large prize, or entrants in many countries, have a lawyer read your rules.

Instagram's own rules

Instagram's help page on promotions sets these requirements:

  • You are responsible for the promotion being lawful. That includes official rules, offer terms and eligibility requirements (such as age and residency limits), and following the rules that apply to the prize and the type of promotion.
  • A complete release of Instagram by each entrant.
  • An acknowledgment that the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.
  • No inaccurate tagging. Don't ask people to tag themselves in content they aren't in, or to tag products that aren't in the photo.

Instagram also says it won't help you run the promotion, and that running one on its service is at your own risk.

Instagram's promotion rules: publish official rules, each entrant releases Instagram, say the promotion isn't sponsored by Instagram, and no inaccurate tagging.

The law where your entrants live

Promotion law is local, and it differs more than people expect:

  • Chance plus prize plus payment is a lottery in many places, including the US, where private lotteries are generally illegal. That is why giveaways say "no purchase necessary": a chance-based giveaway should be free to enter.
  • Contests that are judged on skill (the best photo, the funniest caption) follow different rules from random draws, and some countries regulate them separately.
  • Age and residency limits are common and sometimes required. Many hosts limit entry to adults in the countries they can ship to.
  • Some countries require registration or notices for certain promotions or prize values.

If your audience is global, limit entry to the countries you have checked, and say so in the rules.

Disclose sponsors

If a brand gave you the prize or paid you to run the giveaway, say so clearly, on the post itself and not only in the rules. In the US, the FTC expects disclosures to be hard to miss; Instagram's paid partnership label helps, and a plain "Sponsored by" or "Ad" at the start of the caption works too.

What your official rules should say

Link the rules from the caption or put them in a carousel slide. Cover:

  • Who runs the giveaway, with a way to contact you.
  • Who can enter: age, countries, exclusions such as employees.
  • Start and end date and time, with the time zone.
  • How to enter, and how many entries each person can have.
  • How the winner is picked (a random draw, or judging with the criteria).
  • When and how winners are told, and how long they have to claim.
  • The prize, its approximate value, and whether it can be swapped for cash.
  • What happens if a winner doesn't claim in time (a new draw, for example).
  • How you handle entrants' data.
  • The release of Instagram and the statement that Instagram doesn't sponsor, endorse, run or have any association with the promotion.

A sample line for the last point: "This giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering, you release Instagram from any responsibility."

Entry methods that stay fair

  • Comment a keyword on the post. Simple, easy to check, and it brings comments to the post. Allow one entry per person; extra comments from the same person don't count.
  • Tag a friend in a comment. Common and widely used, but it invites spam comments and people who tag accounts that never asked to be involved. If you use it, cap the number of entries per person.
  • Follow or share to your story. You can ask for these, but checking them takes work: ChatinFlow doesn't verify follows or story shares, so a rule that requires them would have to be checked by hand for every winner. We recommend keeping the entry to the comment, and inviting people to follow without making it a condition.

Running it in ChatinFlow

ChatinFlow's giveaways collect entries from comments that match your post and keyword:

  • One valid entry per person. Repeat entries from the same contact are marked as duplicates automatically.
  • Disqualify by hand. You can remove an entry that breaks your rules, with a reason that stays on record.
  • Draw by hand or on a schedule. Pick winners when you press the button, or at the time you set; the scheduled draw runs within about a minute of it.
  • A random draw you can account for. Winners are picked at random, and each draw records its details, so you can show how a winner was chosen if anyone asks.
  • Prize tiers and claims. Several prizes can have their own winners, and each winner is marked as claimed or forfeited.

To confirm entries privately, pair the giveaway with a comment-to-DM automation on the same keyword: each entrant gets a private reply such as "You're in! Winners announced Friday on my stories." See the comment-to-DM guide for the setup.

Telling the winner: the DM limits

This is where many hosts get stuck. On Instagram, a comment can get one private reply, within 7 days of the comment, and after that you can only write to someone within 24 hours of their last message to you. A giveaway that runs for a week and is drawn on the last day may have no open conversation with the winner.

What works:

  1. Announce winners publicly, in a story or a post, with their handle written correctly.
  2. Ask winners to message you within a set time, such as 72 hours, to claim. Their message opens a conversation, and you can send the claim details right away. In ChatinFlow, a winner who already has an open conversation can get the winner message from the draw; for the rest, you send it from the giveaway once they write.
  3. Warn your followers about fake accounts. Impersonators often message entrants saying "You won, pay shipping here". Say in the post and the rules: "We will only contact winners from this account, and we will never ask for payment or a password."
Reaching the winner: announce publicly, the winner messages you, which opens the chat, and you send the claim details.

A checklist before you post

  • The rules are written, linked, and include the Instagram release and statement.
  • Entry is free, and limited to places where you checked the law.
  • The sponsor, if any, is disclosed on the post.
  • Entry is a comment, one per person.
  • The draw date, time zone and claim deadline are in the rules.
  • Your post warns about fake winner accounts.
